1.  Recurring Payments

Ion Data LLC utilizes your credit card (required) with automatic recurring payments.
Terms and Conditions regarding the Automatic Recurring Payment Program below:

1a.   I authorize Ion Data LLC to pay my bill in full every month within three days starting on your Ion Data LLC billing date, using the credit card information that I have provided. I understand that if the payment is declined, I may be subject to late fees, termination of service, and termination fees.

1b.   I intend to execute this form electronically and I acknowledge that my electronic acceptance binds me as the equivalent of my hand-written signature on this Agreement.

1c.   By completing this enrollment form you authorize Ion Data LLC to charge your credit card automatically each month/quarter/bi-annual/year depending on your service term for as long as you have service with Ion Data LLC and for any other charges that apply under your information services agreement with Ion Data LLC.

You agree to provide Ion Data LLC with your account information and to notify Ion Data LLC if the expiration date or other material information on your credit card changes. Your payment will be processed each month within three days following your Ion Data LLC billing date. You understand and agree that Ion Data LLC is not liable for erroneous bill statements or incorrect charges processed.

If you believe that you have any error on your billing, then you must notify Ion Data LLC in writing or by phone at: Ion Data LLC, PO Box 41866, Mesa AZ 85202 or (480) 831-6677,
within seven (7) days after receipt of your credit card statement, or any claims for erroneous or incorrect charges will be waived. Any credits will be decided within Ion Data LLC's sole discretion and will be applied toward your next Ion Data LLC billing. If your payment is refused by your financial institution for any reason, including over limit, closed account, insufficient funds, or unauthorized account, Ion Data LLC will not be able to process your payment and may terminate your services.

You will be responsible for any and all charges Ion Data LLC incurs because your financial institution refuses payment. If you are participating in this payment option when your account is cancelled, service charges will extend to the end of the month in which the account is cancelled. Your participation in this program is subject to Ion Data LLC's approval.

You understand that Ion Data LLC reserves the right, with or without written notification, to terminate your participation in this program at any time.

2.  Data Lease

2a.   The entire contents of this site and all data published by Ion Data LLC or its affiliates are property of Ion Data LLC under United States law. Except as stated herein, none of the material distributed by Ion Data LLC to customers may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form by any means, including electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of Ion Data LLC.

2b.   All data distributed by Ion Data LLC is for customer use only. If at any time it is discovered that a company, individual, or employee of a customer has knowingly redistributed data or materials provided by Ion Data LLC, without prior consent, to third parties, your company is liable for any and all losses incurred by Ion Data LLC as a result of these actions. This can include but is not limited to any loss of service costs that would have been provided to Ion Data Express and any legal fees incurred through such an action. e.g. You cannot sell or redistribute any of the data you receive from Ion Data LLC without our prior consent. This is a willful violation of the data lease and civil and or criminal actions may be pursued by Ion Data LLC.

2c.   Data is leased to our subscribers and leases are subject to termination at any time. Data lease agreements are contingent on your account staying in good standing and continuing on either a monthly, quarterly, biannual, or annual basis. Any cancellation of service is an effective termination of your data lease with Ion Data LLC and any data or materials distributed by Ion Data LLC is expected to be removed from your system within 30 days of the termination of this agreement.

2d.   All material on this site and published by Ion Data LLC is provided for lawful purposes only. Ion Data LLC is not liable for misuse of our data. Unauthorized use of this material may violate copyright laws, trademarks laws, the laws of privacy and publicity, communications regulations and statutes, or other applicable laws, rules or regulations, and may subject you to criminal penalties and/or civil liability.

3.  Cancellation of Membership

3a.   To cancel your membership, we require authentication that it is actually you making the cancellation. The best and official way to do this is to contact via phone at: (480) 831-6677. Cancellation requests must include the account's login name, and your name, address and phone number and other identifying information as they appear in Ion Data LLC's billing records. If the information provided to Ion Data LLC for an account does not match the account's records, cancellation can be delayed or prevented.

3b.   All Ion Data LLC's accounts must be paid in full before a cancellation will be considered complete. Service charges will extend to the end of the month in which the account is cancelled.

3c.   Ion Data LLC is not responsible for maintaining material that it deletes from its servers as a result of an account cancellation.

3d.   Cancellation of a prepaid account does not include a refund of any kind once the initial thirty (30) days of service has passed, however, Ion Data LLC may issue a refund, at the sole discretion of Ion Data LLC, on a case-by-case basis. Prepaid accounts include, but are not limited to, one (1) year prepay, six (6) month prepay, and three (3) month prepay.

3e.   In the event Ion Data LLC does issue a refund on a case-by-case basis, in its sole discretion, there is a 20% cancellation fee applied to any/all prepay account(s).

4.  Enforcement of Terms and Conditions

These terms are governed by and shall be interpreted according to the laws of the State of Arizona, United States of America, notwithstanding any principles of conflicts of law. Ion Data LLC's failure to enforce any right granted by these Terms and Use or by law shall not be deemed a waiver of its right to enforce any other such right or to take action in response to any future breach of these Terms of Use or violation of the law by you.
